Contractual relationships

By purchasing tickets or other items, contractual relationships come into being exclusively between the customer and the respective organizer or provider. ZSL Betreibergesellschaft mbH (hereinafter “ARENA TICKET”) only arranges tickets or other items in the name and on behalf of the respective organizer and is commissioned by the customer to process the purchase. Events are carried out by the respective organizer, who is also the issuer of the tickets. By purchasing the admission ticket, contractual relationships with regard to attending the event come into being exclusively between the ticket holder (customer) and the respective organizer. The organizer's own general terms and conditions may apply to these legal relationships. ARENA TICKET sells the tickets on behalf of the respective organizer as an agent or as a commission agent, unless ARENA TICKET is expressly identified as an organizer in individual cases or offers its own products that are directly related to an event. When ordering tickets, the customer instructs ARENA TICKET to process the ticket purchase, including shipping. Entrance tickets or other items are sold exclusively to end customers. In individual cases, ARENA TICKET may cooperate with other providers to expand its own products with external service components. For example, the LIVEZIG Upgrade product includes an overnight stay in a partner hotel. With regard to the external service components, the respective general terms and conditions of the cooperation partner apply.

Further regulations or general terms and conditions may come into force upon access to the event venues at the latest.

Conclusion of contract / cancellation

The offer to conclude a contract is made by the customer as soon as he has clicked on the so-called “Buy button”, the clearly labeled button. A contract between the customer and the respective contractual partner (organizer or ARENA TICKET) is only concluded when the transaction number / order number / is assigned and sent by ARENA TICKET to the customer. Deviating from this, if payment is made in advance, the contract with the customer is concluded when full payment has been received into our account. If a contract is concluded by telephone, ARENA TICKET accepts the contract offer by transmitting a reservation number by telephone. The reservation is binding for ARENA TICKET up to 1 week after receipt of the order.

Ticket orders are binding under the subsequent condition that upon receipt of payment, after the set reservation period, the ordered number of admission tickets or other items is no longer available or is no longer available in the selected price category.

Payment for entrance tickets or other items is made exclusively in advance / bank transfer, credit card (VISA and Mastercard), PayPal or when picking up the entry tickets or items at the ARENA TICKET box office at the QUARTERBACK Immobilien ARENA, in cash or with EC card.

No liability is assumed for the accuracy of the data contained in ARENA TICKET's online presence.

ARENA TICKET is entitled to cancel an order from customers who already have a transaction number / order number / order number (unilateral right of withdrawal) if the customer violates specific conditions set by the organizer and / or ARENA TICKET as part of the advance sale has been pointed out, or an attempt has been made to circumvent this (e.g. violation of the restriction on the number of tickets per customer, violation of the terms and conditions of the document, in particular against resale bans, attempted circumvention by registering and using multiple user profiles, etc.) and / or there are outstanding claims from the previous business relationship with the customer . Sections 346 ff. of the German Civil Code (BGB) apply to the aforementioned right of withdrawal, excluding Section 350 of the German Civil Code (BGB).

In the event that the general terms and conditions of the organizer and the general terms and conditions of ARENA TICKET contain conflicting regulations, the general terms and conditions of ARENA TICKET take precedence over the specific terms and conditions of the organizer.

Price composition and shipping

The prices offered for admission tickets include fees and VAT and may differ from the printed ticket price. When sending the tickets or items to the customer, Arena Ticket charges a transport fee for the DHL package shipping method. This includes postage, insurance during transport and packaging. Other shipping methods include paid letter mail, without insurance coverage, and the digital delivery method Print@Home.

When ordering online, service and shipping costs will be charged, which may vary depending on the event. These fees are displayed to the customer in the shopping cart when ordering, and there are no additional costs not shown.

Payments are possible via the payment methods mentioned above. If payment is not made within the deadline, there are insufficient credit card or account funds or there are disruptions with payment providers such as Paypal, ARENA TICKET is entitled to cancel the order without replacement or to block the corresponding tickets; The corresponding tickets therefore lose their validity. The assertion of claims for damages is expressly reserved in this case.

The order will be shipped as mentioned above. Alternatively, orders for selected events can be picked up at the ARENA TICKET box office at the QUARTERBACK Immobilien ARENA during business hours.

If the print@home ticket form is chosen, it is the customer's responsibility to carry the ticket in printed form as admission authorization.

Right of withdrawal/return

If ARENA TICKET offers services in the area of leisure events on behalf of the organizer/provider, in particular tickets for events, this does not constitute a distance selling contract within the meaning of Section 312 b III No. 6 BGB. This means that card returns or exchanges are excluded. There is therefore no right of withdrawal for consumers, or the right of withdrawal for consumers may expire prematurely.

After confirmation of receipt of payment by ARENA TICKET, the customer is obliged to accept the tickets/postal delivery of his order. Changes to the program and line-up are not intended, but remain reserved and do not entitle you to return tickets.

If an event is canceled, the ticket price will only be refunded for tickets purchased from ARENA TICKET, provided that the respective organizer allows the tickets to be canceled by ARENA TICKET. The transport flat rate and online fee will not be refunded in this case. In this case, ARENA TICKET must have the original of any ticket to be canceled no later than 14 days after the original event date. To the extent that ARENA TICKET information about canceled or changed event dates is available, buyers will be informed of this provided they provided a valid email address when ordering. Alternatively, this information is provided on the ARENA TICKET website.

Customer account

Customers can create a free customer account by registering. Customers can view their orders and change their stored data via their customer account. The use of a customer account is voluntary and not a necessary requirement for an order.

By sending a corresponding confirmation email after completing registration in the customer account system, a user agreement regarding the respective account is concluded between the customer and ARENA TICKET.

The access data provided during registration, in particular the password, must be kept carefully by the customer. The password may not be passed on to third parties. If a customer becomes aware of the misuse of his access data, he must inform ARENA TICKET immediately.

Information regarding the processing of personal data relating to the customer account is provided in the data protection information.

The customer can terminate the user agreement without notice with immediate effect by notifying ARENA TICKET. As a result, the customer no longer has access to the data stored in the customer account.

ARENA TICKET recommends that the customer not terminate the user agreement as long as there are still active orders for events in their customer account.

ARENA TICKET reserves the right to temporarily block the customer account, especially if it is misused for fraudulent or other illegal purposes or by unauthorized third parties. In the event of misuse of the customer account, ARENA TICKET also has the right to terminate the user agreement with five calendar days' notice. The right to terminate for good cause remains unaffected.

Data protection

For ARENA TICKET, compliance with the applicable data protection regulations is a matter of course. ARENA TICKET uses the data within the framework of the legal provisions, for example: to carry out the contract or to inform customers about ARENA TICKET's goods or services that are similar to the previously ordered goods or services. Retention of title; On Bill

In the case of a consumer, ARENA TICKET reserves ownership of the purchased item until the invoice amount has been paid in full. In the case of issuing personalized tickets, the transfer of the claim resulting from the ticket or the recording of personal data is subject to the condition of full payment of the invoice amount. The corresponding security rights are transferable to third parties.

If the customer is an entrepreneur in the exercise of his commercial or independent professional activity, a legal entity under public law or a special fund under public law, ARENA TICKET reserves ownership of the purchased item until all outstanding claims from the business relationship with the customer have been settled. In the case of issuing personalized tickets, the transfer of the claim resulting from the ticket or the recording of personal data is subject to the condition that all outstanding claims from the business relationship with the customer are settled. The corresponding security rights are transferable to third parties.

The customer only has the right to offset if his counterclaims have been legally established or are undisputed or recognized by ARENA TICKET. In addition, the customer only has a right of retention if and to the extent that his counterclaim is based on the same contractual relationship.

If the customer is in arrears with any payment obligations towards ARENA TICKET, all existing claims become due immediately.

Limitations of liability, exclusion of withdrawal in the event of certain breaches of duty

In any case, ARENA TICKET is liable without limitation for damage caused intentionally or through gross negligence, for fraudulent concealment of defects, as well as for damage resulting from injury to life, body or health. Liability for damages resulting from a breach of a warranty is also unlimited.

In the event of a breach of essential contractual obligations (so-called cardinal obligations), which is based only on simple negligence, ARENA TICKET's liability is limited to compensation for the foreseeable, contract-typical damage.

Except in the cases mentioned in paragraphs 1 and 2, ARENA TICKET is not liable for damage caused by simple negligence.

The customer's right to withdraw from the contract due to a breach of duty for which the organizer or ARENA TICKET is not responsible and does not consist of a defect in the goods is excluded.

To the extent that ARENA TICKET's liability is excluded or limited in accordance with the above paragraphs, this also applies to the liability of its vicarious agents and vicarious agents.

Final clauses

Subsidiary agreements, changes and additions to the order as well as its service components including this provision and the approvals by ARENA TICKET required under these conditions must be in writing to be effective. This also applies to a waiver of the written form requirement.

If a customer orders for several people, all persons must accept declarations made by or to one of them as valid for and against themselves.

If individual components of the order are or become ineffective, the effectiveness of the remaining services from the order remains unaffected. ARENA TICKET and the customer are obliged to make appropriate adjustments.

For all disputes about the order, including these conditions, as well as for the fulfillment of all obligations, Leipzig is agreed as the place of performance and jurisdiction, provided that the buyer does not have a general place of jurisdiction in Germany or moves his place of residence or habitual residence abroad after conclusion of the contract or his place of residence or habitual abode is in The time at which the action is filed is not known if the buyer is a registered trader, a legal entity under public law or a public special fund.
